Terms & Conditions
1. Platform Purpose
CivicGuard is a civic reporting platform. It is not a law enforcement agency and does not guarantee municipal action on any report.
2. Eligibility
You must be 18 years of age or older to create an account. Use is restricted to residents of India. By registering, you confirm that you meet this requirement. We rely on self-declaration and do not independently verify age.
3. Acceptable Use
- Reports must be truthful and based on actual observations
- No fake, spam, or malicious reports
- No harassment of individuals in photos or descriptions
- Do not submit photos containing clearly identifiable private individuals without their consent
- Do not attempt to reverse-engineer, scrape, or abuse the platform APIs
4. Report Accuracy
You are responsible for the accuracy of submitted reports. False reports may result in account suspension.
5. Civic Credits
Credits are non-transferable and have no monetary value. CivicGuard reserves the right to modify or discontinue the credits system at any time without liability.
6. Content License
By submitting a report, you grant CivicGuard a non-exclusive, royalty-free, worldwide license to display, reproduce, and share the report content on the platform and with relevant municipal bodies (BMC, TMC, NMMC) for civic action purposes. This license survives account deletion for reports already shared with authorities.
7. Moderation
CivicGuard may reject, remove, or escalate reports at sole discretion with no obligation to explain. CivicGuard acts as an intermediary platform and is not liable for user-generated content under Section 79 of the Information Technology Act 2000.
8. Subscriptions & Billing
Paid plans (Community and Campus) are billed monthly via Razorpay. By subscribing, you authorise CivicGuard to collect recurring payments via your chosen payment method (UPI AutoPay, card, or net banking).
- Trial: All paid plans include a 30-day free trial. No charge is made until the trial ends.
- Auto-renewal: Subscriptions renew automatically each month unless cancelled before the renewal date. You will receive a payment notification from your bank 24–48 hours before each debit (NPCI mandate).
- Cancellation: You may cancel at any time by emailing support@civicguard.in or by cancelling the UPI mandate directly from your UPI app. Cancellation takes effect at the end of the current billing cycle. No partial refunds are issued.
- Downgrade: On cancellation or non-payment, your organisation is downgraded to the free Starter plan at the end of the billing period. Your reports and data are retained.
- Price changes: CivicGuard may change subscription prices with 30 days advance notice by email. Continued use after the notice period constitutes acceptance of the new price.
Full refund terms are in our Refund & Cancellation Policy.
9. Account Termination
You may delete your account at any time by contacting support@civicguard.in. Upon deletion:
- Your personal profile and contact details are erased within 30 days
- Reports already approved and published remain on the platform as anonymised civic records (personal attribution is removed)
- Pending reports are withdrawn automatically
- Any active paid subscription is cancelled immediately with no refund for the remaining period
CivicGuard may suspend or terminate accounts that violate these terms, with notice where practicable. Serious violations (fraud, abuse, false reports at scale) may result in immediate termination without notice.
10. Intellectual Property
All platform software, design, logos, and branding are owned by CivicGuard. You may not copy, modify, distribute, or create derivative works from any part of the platform without written permission.
11. Disclaimers
CivicGuard is not affiliated with any government body. We do not guarantee that reports will be acted upon by municipal authorities. The platform is provided as-is with no guaranteed uptime or SLA for free-tier accounts.
12. Limitation of Liability
To the maximum extent permitted by applicable law, CivicGuard is not liable for any indirect, incidental, or consequential damages arising from use of the platform. Our total aggregate liability shall not exceed the amount you paid us in the 3 months preceding the claim.
13. Force Majeure
CivicGuard is not liable for failure to perform obligations caused by circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, internet outages, or third-party service failures.
14. Governing Law
These terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
15. Changes
Material changes to these terms will be notified via email or SMS with 30 days notice. Continued use after the notice period constitutes acceptance.
